General Terms and Conditions 

The purpose of this contract is to define the general terms and conditions of sale (GTC) of the products offered by Méthode Mathilde (SIRET 914395033) on its online store https://methodemathilde.com/

The company will be referred to below as "the seller". The person purchasing the company's products will be referred to as "the customer". The seller is a creator and publisher of sewing patterns destined to individuals. These are marketed through its website.

Article 1: Object

The GTC determine the rights and obligations of the parties in the context of Méthode Mathilde products's online sale.

Article 2: General provisions

The GTC apply to all sales of products made through the seller's website. They are an integral part of the contract between the customer and the seller. The seller reserves the right to modify these, at any time, by publishing a new version on its website. The GCS then applicable are those in force on the date of the order's payment. The seller ensures that their acceptance is clear. The customer declares to have read these and accepts them without restriction or reservation.

Article 3: Price

The prices of the products sold on the online store are indicated in Euros including taxes. They are indicated on the product's description page, on the cart page and on the checkout page. The seller reserves the right to modify its prices at any time for the future.

Article 4: Conclusion of the online contract

The customer will receive an order confirmation by e-mail. In accordance with article 1316-1 of the civil code, the customer undertakes to provide his true identification elements. The seller reserves the right to refuse the order, for instance, for any abnormal request, made in bad faith or for any legitimate reason.

Article 5: Products

The essential characteristics of the products and their respective prices are made available to the customer on the seller's website. The parties agree that the illustrations or photos of the products available for sale have no contractual value.

Article 6: Conditions of use of purchased products

The purchase corresponds to a strictly personal and non-transferable user license. Any commercial use is prohibited. The use of Methode Mathilde patterns as supports for sewing lessons is prohibited.

Article 7: Intellectual property rights

Trademarks, domain names, sewing patterns, images, videos, texts or more generally any information subject to intellectual property rights are and remain the exclusive property of the seller. No assignment of intellectual property rights is made through these GTC. Any total or partial reproduction, modification or use of these goods for any reason whatsoever is strictly prohibited.

Article 8: Downloads

PDF patterns can be downloaded via the order summary page and via the link sent automatically to the e-mail address indicated when ordering. The PDF pattern download link sent by email expires after three downloads.

Article 9: Payment

Secure online payment by credit card is made by our payment providers Stripes and PayPal. In accordance with the provisions of the monetary and financial code, the commitment to pay given by card is irrevocable. By communicating his banking information during the sale, the customer authorizes the seller to debit his card for the amount relating to the price indicated. The customer confirms that he is the legal holder of the card to be debited and that he is legally entitled to use it. In the event of an error, or the impossibility of debiting the card, the sale is cancelled.

Article 10: Retractation period

In accordance with article L 121-20-2 of the consumer code, the right of retractation cannot be exercised for intangible products. Thus, the purchase of PDF patterns is final and non-refundable.

Article 12: Force majeure

The performance of the seller's obligations under these GTC is suspended in the event of the occurrence of a fortuitous event or force majeure which would prevent its performance. The seller will notify the customer of the occurrence of such an event as soon as possible.

Article 13: Protection of personal data

In accordance with the data protection cct of January 6, 1978, the customer has the right to query, access, modify, oppose and rectify personal data concerning him. By adhering to these GTC, the customer consents to this data being collected and used for the conclusion of this contract.

Article 14: Mediation clause

In the event of a dispute, the parties will prefer an amicable resolution of the dispute before entering the competent court, in application of the articles of the code of civil procedure.

Article 15: Applicable law

All the clauses appearing in these GTC as well as all the purchase and sale transactions referred to therein, will be subject to French law.
